GST ASMT-05 explained: furnishing bond and security

ASMT-05 is the form in which you furnish a bond, along with security such as a bank guarantee, after the officer allows provisional assessment in ASMT-04. It protects the revenue in case the final tax turns out higher than the provisional tax you paid.

Why a bond is required

Section 60 allows provisional payment only if you undertake to pay the difference between provisional and final tax. The bond is that undertaking; the security backs it. Rule 98 says the security cannot exceed 25 percent of the amount covered under the bond, and the exact figures are those stated in ASMT-04.

How to furnish ASMT-05

ASMT-05 is filed on the GST portal with the bond details, and the security, typically a bank guarantee, is furnished to the proper officer as directed. A bond already furnished under the CGST Act or IGST Act is treated as furnished under the corresponding law too, so separate bonds are generally not needed for each Act.

  • Check the bond amount matches the ASMT-04 order
  • Get the bank guarantee drafted in favour of the authority named, for the amount ordered
  • Keep the validity of the guarantee beyond the expected final assessment date
  • Keep the signed bond and guarantee copies with your provisional assessment file

During the provisional period

Pay tax on covered supplies at the provisional value or rate and keep invoice-wise workings. Renew the bank guarantee before expiry if the final assessment is extended. A lapsed guarantee can lead the officer to treat the condition of provisional assessment as breached.

Getting the security back

Once the final assessment order is issued in ASMT-07 and you have paid any amount it determines, you apply for release of the security in ASMT-08. The officer releases it by an order in ASMT-09, which Rule 98 requires within seven working days of the application.

Banks often take time to issue and later cancel guarantees, so plan both ends early and keep the bank informed of where the assessment stands.
