DRC-08 is the summary uploaded when a demand order is rectified under Section 161 or withdrawn. If your DRC-07 contains an obvious error, you can ask for rectification, and the corrected order is reflected through DRC-08.
Section 161 covers errors apparent on the face of the record: arithmetical mistakes, wrong period, a payment ignored, a figure taken twice, or a demand that does not follow from the order's own findings. It is not a route to re-argue the merits; that requires an appeal.
Common examples include an order that ignores a payment made through DRC-03 before the order, interest computed for the wrong period, a demand that totals heads incorrectly, or a penalty that conflicts with the section invoked. These can be corrected without arguing the merits again.
The officer can rectify within three months from the date of the order, on his own or when the error is brought to notice by you within three months of the order. No rectification is allowed after six months from the date of the order, except for clerical or arithmetical errors arising from an accidental slip or omission. If rectification would adversely affect you, a hearing must be given first.
File the rectification application on the portal against the order, explaining the error and attaching proof, such as the DRC-03 challan the order ignored or the correct computation. Keep a copy and the ARN. The officer's decision is uploaded as DRC-08, and the liability register is updated.
A rectification application does not automatically extend the appeal deadline for the original order. If the error is significant or the rectification may not be decided quickly, file the appeal within time as well and mention the pending rectification. Once DRC-08 is issued, check whether the revised demand needs a fresh appeal or an amendment of the pending one.
