GST DRC-19 explained: recovery of GST dues as if a fine

DRC-19 is an application by the GST officer to a Magistrate under Section 79(1)(f) and Rule 156, asking that unpaid GST dues be recovered as if they were a fine imposed by the Magistrate. It is one of the last-resort recovery tools.

What it means

The Magistrate is asked to recover the amount using the procedure applicable to recovery of fines. It is rarely used compared with bank recovery and property attachment, but it shows that the dues have been pending a long time and other modes may not have worked.

The application is made to a Magistrate having jurisdiction, and the Magistrate then proceeds as if recovering a fine imposed by him. The GST demand itself is not re-examined on its merits in these proceedings; merits are decided in appeal.

What to check

  • The order and demand on which the application is based
  • Whether the demand is final, or an appeal with pre-deposit is pending
  • Whether payments or DRC-03A adjustments were missed
  • Whether the demand was reduced in appeal or rectification, requiring a DRC-25 intimation

How to respond

Engage an advocate for the proceedings before the Magistrate. Place on record any payment, stay or reduction of the demand. If the dues are correct, paying them and having the GST officer withdraw the application is the cleanest resolution. If cash is the problem, discuss whether an instalment request under Section 80 is still possible; it is not available where recovery is already under way for a default.

Prevention

Most cases reach this stage because notices were missed. Keep the registered email and mobile current on the GST portal, check the notices section regularly, and act on DRC-07 orders within the appeal period.

If you have changed your address or email since registration, update the portal immediately so that future orders reach you.
