GST DRC-20 explained: applying for extra time or instalments

DRC-20 is the application for extension of time or payment in instalments under Section 80 and Rule 158. The Commissioner can allow up to 24 monthly instalments for amounts other than self-assessed tax shown in a return, with interest.

Who can apply

Section 80 covers amounts due under the Act other than tax self-assessed in a return, so it is mainly used for demands confirmed in orders. Rule 158 bars the facility in these cases:

  • You have already defaulted on an amount for which recovery proceedings are under way
  • The condition in Rule 158 relating to instalments allowed in the preceding financial year is not met
  • The amount for which instalments are sought is less than Rs. 25,000

How to apply

File DRC-20 on the portal with the demand reference, the amount, and reasons, ideally supported by financial statements, bank statements and cash flow projections showing why immediate payment is difficult and how you will pay. The Commissioner calls for a report from the jurisdictional officer on your financial position before deciding. The decision comes in DRC-21.

The application should be realistic. Showing past compliance, the reason for the cash crunch, such as delayed receivables, and a schedule matched to expected inflows makes a stronger case than a general request for 24 instalments.

Interest and default

Interest under Section 50 continues on the unpaid amount. If you default on any one instalment, the whole outstanding balance becomes payable immediately and can be recovered without further notice. Plan instalments you can actually meet.

Practical points

Apply early, before recovery action starts. If you intend to appeal, remember that instalments do not replace the pre-deposit and do not extend the appeal deadline. A professional can prepare the financial justification and the payment plan.

Keep a copy of the application and any report the officer calls for, and respond quickly to queries about your finances.
