GSTR-3A explained: the default notice for non-filing of returns

GSTR-3A is a notice the portal issues to a registered person who has not filed a required return. It gives 15 days to file the return with tax, interest and late fee. If you do not, the officer can assess your tax on best judgement, and continued non-filing can lead to cancellation of registration.

When GSTR-3A is issued

Section 46 of the CGST Act and Rule 68 provide for this notice when a person fails to file a return under Section 39 (such as GSTR-3B or GSTR-4), Section 44 (annual return), Section 45 (final return GSTR-10) or Section 52 (GSTR-8). It is issued electronically and appears in the notices section of your portal login, with a copy by email.

What you should do

The simplest and best response is to file the pending return within 15 days of the notice, paying tax, interest and late fee. There is no separate reply form; filing the return is the compliance. If you believe the return was in fact filed, or you were not liable for that period, keep the acknowledgement or evidence ready and respond through the officer in writing.

If the return is still not filed

  • The officer can pass a best judgement assessment order under Section 62 in ASMT-13, based on available information
  • That order is deemed withdrawn if you file a valid return within 60 days of its service; a further 60 days is available with an additional late fee
  • Tax demanded in the order can be recovered, including by attachment of bank accounts
  • Not filing returns for a continuous period can lead to suspension and then cancellation of registration under Section 29

Avoiding repeated notices

Many GSTR-3A notices go to businesses that have stopped operating but did not cancel their registration. If the business is closed, apply for cancellation and file the final return rather than letting notices pile up. If cash flow is the reason for delay, filing the return even without full payment stops the non-filing notice, though interest and recovery for unpaid tax still follow.

A professional can file the backlog, compute interest and late fees, and respond to any ASMT-13 order or cancellation proceedings that have started.
