GST MOV-08: bond and security for provisional release

MOV-08 is the bond furnished, along with security, to obtain provisional release of goods or a conveyance detained under Section 129. It lets the goods move while you contest the proposed penalty, instead of paying it at once.

When to use MOV-08

If you believe the detention or the proposed penalty is wrong but cannot keep the goods or vehicle waiting, provisional release on security is the practical route. The security is equal to the penalty amount payable under Section 129(1), and the bond binds you to pay if the final order confirms the penalty.

Provisional release is especially useful for perishable goods, raw material meant for a production line, or goods with a delivery deadline, where waiting for the order in MOV-09 would cause losses larger than the cost of arranging security.

What you need to provide

  • The bond in MOV-08, executed by the owner of goods or the person seeking release
  • Security in the form accepted by the officer, often a bank guarantee
  • Reference to the detention order in MOV-06 and the notice in MOV-07
  • Identity and authorisation of the person signing

After provisional release

The goods and conveyance are released through MOV-05. The proceedings continue: you file your reply to MOV-07 and attend the hearing, and the officer passes the order in MOV-09.

If the penalty is confirmed and not paid, the security can be enforced to recover it. If the penalty is dropped or reduced, ask for release of the security in writing, quoting the order.

Practical tips

Keep the bank guarantee valid until the matter is closed, including any appeal. Diary the dates of the MOV-07 reply and hearing so the proceedings are not decided ex parte while the goods are already released. A representative can prepare the bond papers and handle the reply and appeal.
