GST REG-12 explained: temporary registration by the officer

GST REG-12 is an order by which the proper officer registers a person on a temporary basis when a survey, inquiry, inspection or search shows that the person was liable to register but did not apply. The person must then apply for regular registration within 90 days.

When REG-12 is issued

Rule 16 allows the officer to register a person suo moto when proceedings under the Act find that the person is liable to registration and has failed to apply. Typical triggers are inspections of unregistered traders whose turnover crosses the threshold, e-way bill detentions of goods moved by unregistered suppliers, and information from other departments. The officer may also use a temporary ID to issue notices or accept payments.

Effect of temporary registration

The registration is effective from the date of the REG-12 order. The person is treated as registered for that purpose, and tax, interest and penalty for the period of default can be demanded through separate proceedings. Returns and payment obligations start running.

What you must do next

Within 90 days of the grant of temporary registration, apply for regular registration in REG-01, or REG-07 where applicable. If you have filed an appeal against the grant of temporary registration, the application must be filed within 30 days from the date of the appellate order upholding the liability to register.

  • Read the order and the basis on which liability is assumed
  • Check turnover records to confirm whether you really crossed the threshold
  • Apply for regular registration in time, or appeal if liability is wrong
  • Prepare for any demand for past periods

Common errors

  • Ignoring REG-12 because no regular GSTIN was applied for
  • Continuing to sell without tax invoices after the order
  • Not preserving evidence of turnover below the threshold
  • Missing the 30-day window after an appeal is decided
