GST RFD-03 deficiency memo: why it is issued and what to do

RFD-03 is a deficiency memo issued when the refund officer finds your RFD-01 incomplete, for example because a statement or document is missing. It is issued under Rule 90(3), normally within 15 days of filing, and you must file a fresh application after correcting the deficiency.

Why RFD-03 is issued

A deficiency memo is about completeness, not the merits of the claim. If the officer thinks the claim is wrong on merits, the correct route is a show cause notice in RFD-08, not RFD-03.

  • Missing invoice statement or wrong format
  • Shipping bills, export proof or SEZ endorsement not uploaded
  • Unjust enrichment declaration or CA certificate missing where required
  • Undertakings or self-declarations not attached

What to do after receiving it

Read the memo carefully and note every deficiency listed. Prepare the missing material and file a fresh RFD-01 for the same period and category. The portal allows a new application for that period once a deficiency memo is issued against the earlier one.

For claims where ITC was debited at the time of filing, the amount is re-credited to the electronic credit ledger after the deficiency memo, so it can be debited again with the fresh application.

Effect on the two-year time limit

The period from the date of filing the original application until the date the deficiency memo is communicated is excluded when computing the two-year limit under Section 54(1). Even so, refile promptly; a long gap between the memo and the fresh claim can create avoidable limitation arguments.

Common mistakes

Taxpayers sometimes reply to RFD-03 by letter instead of refiling, or refile without fixing every point and receive a second memo. If you believe the memo lists something that was in fact uploaded, write to the officer with the page reference before refiling. A professional can check the refile for completeness so it is acknowledged in RFD-02.

Questions

RFD-03 — FAQs

Can I reply to an RFD-03 deficiency memo?+
The memo is not answered by a reply. You correct the deficiency and file a fresh RFD-01 for the same period.
Is a deficiency memo the same as rejection?+
No. It treats the application as incomplete. Rejection on merits requires a notice in RFD-08, an opportunity to reply and an order in RFD-06.
Will I lose time because of a deficiency memo?+
The time from the original filing to the communication of the memo is excluded from the two-year limit, but you should refile without delay.
