Missed the 90-day GST revocation deadline: what you can still do

Missing the 90-day window for REG-21 does not always end the matter, but your options narrow. Depending on how late you are, you can ask for an extension, appeal the cancellation order, or as a last resort take a fresh registration. Each has its own time limit, so act quickly.

Option 1: extension of the revocation period

Rule 23 allows the 90-day period to be extended, on sufficient cause and for reasons recorded in writing, by the Commissioner or an officer authorised by him not below Joint or Additional Commissioner, for a further period of up to 180 days. Write an application explaining the reason for delay, such as illness, closure of premises, or the notice not being seen, with evidence, and file the REG-21 along with it.

Option 2: appeal against the cancellation order

The cancellation order in REG-19 is an appealable order. An appeal in APL-01 lies within three months of communication of the order, and the appellate authority can condone a further one month of delay for sufficient cause. In an appeal you argue that the cancellation itself was wrong, for example because the notice was never properly served or returns had in fact been filed.

Option 3: High Court or fresh registration

Beyond the appeal window, the appellate authority has no power to condone delay. Businesses then either approach the High Court through a writ petition, usually where natural justice was not followed or the livelihood impact is severe, or apply for a new registration. A new registration means a new GSTIN, and liabilities of the old one remain.

Before choosing

  • Work out exact dates: order date, date of service, today's date.
  • File pending returns for the old GSTIN in any case; they are a pre-condition for revocation and reduce exposure.
  • Keep evidence of why you missed the deadline.
  • Do not continue trading on the cancelled GSTIN while deciding.

Questions

Revocation time limit over — FAQs

Is extension automatic?+
No. It is discretionary and needs sufficient cause and reasons recorded in writing.
Can I appeal and seek revocation at the same time?+
They are separate routes. Many businesses seek revocation if the window is open and appeal where it is not; take advice on the facts.
Will a fresh registration be refused because of the old one?+
It may attract questions or verification, especially if dues on the old GSTIN are unpaid.
What counts as sufficient cause for delay?+
There is no fixed list. Serious illness, death of the proprietor or a key person, closure of premises, or a notice that was genuinely not received are commonly put forward. Whatever the reason, support it with documents such as medical records or correspondence rather than a bare statement.
