GST revocation application rejected: what to do next

If your revocation application was rejected, the order will be in Form REG-05, usually after a REG-23 notice asking you to explain. You can appeal the rejection, and in some cases the better course is to fix the defect and argue it in appeal with full documents.

Why revocations are rejected

  • Returns not filed up to the required date, especially the months between the effective date and the order date in retrospective cancellations.
  • Dues shown in returns or in the cancellation order not paid.
  • Place of business not verified or documents not matching the registered address.
  • No reply to REG-23 within 7 working days.
  • Application filed after the time limit without a request for extension.

If you have a REG-23 notice now

Reply in REG-24 within 7 working days. Address each point in the notice, attach proof such as return ARNs, challans, rent agreement and photographs, and ask for a personal hearing if the issue needs explanation. An unanswered REG-23 almost always ends in rejection.

Appealing a REG-05 order

  • File APL-01 within three months of communication of the order; one further month can be condoned for sufficient cause.
  • Attach the cancellation order, the REG-21, the REG-23, your reply and the REG-05.
  • Show in the grounds that the defects have been cured, or that the officer ignored evidence.
  • Pre-deposit of 10 percent applies to tax in dispute; where the order involves no tax demand, no tax pre-deposit arises.

Things to avoid

Do not file a second REG-21 on the same facts after rejection without curing the cause; it is likely to be rejected again and the appeal clock keeps running. Do not trade on the cancelled GSTIN while the appeal is pending. Keep the cancellation and revocation papers together, since the appellate authority will look at the whole history.

Questions

Revocation rejected — FAQs

Can the appellate authority restore my registration?+
Yes. If the appeal is allowed, the cancellation can be set aside and the registration restored.
Is a hearing given before rejection?+
The REG-23 notice is the opportunity to explain; request a hearing in your reply if needed.
Should I take a new registration instead?+
That depends on dues on the old GSTIN and business needs; liabilities of the old GSTIN remain either way.
Does the appeal clock start from the REG-05 date?+
It starts from the date the rejection order is communicated, which for portal orders is normally the date of upload. Diary that date as soon as you see the order, since only one extra month can be condoned for delay.
