Received a section 74A notice? How it works and how to respond

From financial year 2024-25, GST demands for tax not paid, short paid, wrongly refunded or ITC wrongly availed are raised under a single section, 74A, instead of separate sections 73 and 74. The notice states whether fraud, wilful misstatement or suppression is alleged, and that choice drives the penalty and your best response.

Key time limits

  • The show cause notice must be issued within 42 months from the due date of the annual return for the financial year, or from the date of erroneous refund.
  • The order must be passed within 12 months of the notice, which a senior officer can extend by up to six months with reasons.
  • No notice is issued where the tax involved is less than Rs. 1,000 for the year.

Penalty depends on the allegation

Where fraud or suppression is not alleged, penalty is 10 percent of tax or Rs. 10,000, whichever is higher. If you pay the tax with interest within 60 days of the notice, no penalty is payable and proceedings close. Where fraud, wilful misstatement or suppression is alleged, penalty equals the tax, reduced to 15 percent if paid before the notice, 25 percent if paid within 60 days of the notice, and 50 percent if paid within 60 days of the order.

How to respond

  • Check the year and the dates against the time limits.
  • Check whether the notice gives specific reasons for alleging fraud or suppression; a bare allegation can be contested.
  • Decide issue by issue whether to pay within 60 days or contest.
  • Reply in DRC-06 with documents and request a hearing.
  • If you pay part, pay through DRC-03 and mention it in the reply.

Mistakes to avoid

Do not treat a 74A notice like an old section 73 notice; the payment window is 60 days, not 30. Do not accept the fraud tag casually, because it raises penalty exposure considerably. For periods up to FY 2023-24, the older sections 73 and 74 still apply, so a notice for those years under 74A should be examined carefully.

Questions

Section 74A notice — FAQs

Can the officer change a non-fraud case into a fraud case later?+
The notice should state the basis. If the allegation is not in the notice, the order cannot rely on it beyond the notice under section 75(7).
Does paying within 60 days mean admitting guilt?+
It is a choice to close the issue at lower cost; it does not have to be framed as admission of fraud where none is alleged.
Is a hearing given under 74A?+
Yes. Section 75(4) on hearings applies to these proceedings as well.
