Anti-profiteering under GST explained

Anti-profiteering refers to Section 171 of the CGST Act, which requires that any reduction in the GST rate or any benefit of input tax credit be passed on to the recipient through a matching reduction in price. It targets suppliers who keep the tax saving instead of lowering prices.

What the law requires

When the rate on a product falls, the base price should not be quietly raised to keep the tax-inclusive price unchanged. Similarly, where a business gets a new benefit of ITC that was not available earlier, it is expected to reflect that benefit in its prices. The obligation is on a commensurate reduction, not merely on lowering prices by some amount.

Who examines complaints

The National Anti-Profiteering Authority was the original body. Its functions were later transferred to the Competition Commission of India, and the law has since been amended to bring the GST Appellate Tribunal into this role and to allow the government to notify a date after which new requests are not accepted. Businesses should check the current position for the period in question.

Practical steps for businesses

  • Keep price lists before and after any rate change
  • Document the calculation of base price and tax for affected products
  • Record reasons for any genuine price increases, such as raw material costs
  • Ensure MRP-based products show revised prices where required
