A nil return is a GST return filed for a period in which you had no outward supplies, no inward supplies under reverse charge, no credit to claim and no tax to pay. Having no business in a month does not remove the duty to file.
A GSTR-3B is nil only when every table is zero: no sales, no reverse charge purchases, no ITC claimed, no interest or late fee payable. A GSTR-1 is nil when there are no outward supplies, credit notes or debit notes to report. If you bought anything on which you want to claim credit, the return is not nil.
Nil GSTR-1, GSTR-3B and the composition statement CMP-08 can be filed on the GST portal, and the portal also offers an SMS-based filing facility from the registered mobile number, confirmed by OTP. Portal filing can be verified through EVC or a digital signature.
Late fee under Section 47 applies even to nil returns, though at a reduced level. Continuous non-filing can lead to a suspension and a REG-17 notice for cancellation under Section 29. If the business is genuinely closed, applying for cancellation is usually better than leaving returns unfiled month after month.
