Rectification is the correction of an error apparent on the face of the record in a GST order, notice or decision. It is faster than an appeal, but only works for obvious mistakes, not for disputes on facts or law.
Section 161 of the CGST Act allows the authority who passed an order to rectify any error apparent on the face of the record, on its own motion, on information from an officer, or on an application by the affected person. The taxpayer must apply within three months from the date of issue of the order.
No rectification can be made after six months from the date of issue of the order, except where the correction is purely clerical or arithmetical. If the rectification adversely affects any person, natural justice must be followed, including a hearing.
Filing a rectification application does not automatically extend the time limit for appeal. If the error is part of a larger dispute, consider filing the appeal within three months alongside or instead of the rectification. A professional can judge which route is safer.
