GST registration for cab operators, taxi drivers and fleet owners

Passenger transport by cab is a taxable service, but GST treats a ride booked through an app very differently from a trip you sell directly. A driver who works only through a ride-hailing app is in a different position from a fleet owner running corporate employee transport, and the registration answer follows from that difference.

Rides booked through apps

Under Section 9(5), the e-commerce operator pays GST on passenger transport by radio taxi, motor cab, maxi cab, motor cycle or omnibus supplied through it. When a passenger books an app ride, the app is liable for the tax, not the driver or the fleet owner who supplied the car.

Service suppliers selling through an e-commerce operator are not compulsorily registered below the threshold. So an individual driver attached only to an app usually does not need a GSTIN unless other income on the same PAN takes aggregate turnover past Rs. 20 lakh (Rs. 10 lakh in Manipur, Mizoram, Nagaland and Tripura).

Direct and corporate business

Fleet owners who supply cabs to IT companies for employee pick-up and drop, run airport transfers for hotels or take outstation bookings by phone are supplying the service themselves. That turnover counts toward the threshold, and corporate clients almost always want a tax invoice.

Some arrangements, such as renting a motor vehicle with fuel by a non-body-corporate to a body corporate, can fall under reverse charge in certain cases, with the corporate client paying the tax. Your contract wording, whether you supply transport of passengers or rent the vehicle, decides which rule applies, so draft it carefully.

  • App trips: tax paid by the operator under Section 9(5).
  • Direct trips and corporate contracts: tax paid by you once registered.
  • Certain vehicle rentals to body corporates: check whether reverse charge applies.

Input tax credit on vehicles

Section 17(5) blocks credit on motor vehicles for transport of persons, but an exception applies where the vehicle is used for further supply of transportation of passengers. A registered fleet operator buying cars for its taxi business may therefore be able to claim credit on the vehicles, subject to the scheme under which it pays tax. Check the eligibility before you claim, since a wrong claim leads to demand notices with interest.

Documents and practical points

Keep ready PAN, Aadhaar and photograph, proof of the office or parking space, constitution proof if you operate as a firm or company, an authorisation letter and a cancelled cheque. Add bank details within 30 days of registration or before the first GSTR-1.

  • Mixing app income and direct income without separate records.
  • Signing corporate contracts that do not say whether you rent the car or supply transport.
  • Claiming vehicle credit without checking the scheme you pay tax under.

Questions

Cab operators — FAQs

Does a cab driver on a ride-hailing app need GST registration?+
Usually not, if all trips come through the app and turnover is below the threshold. The app pays tax on those rides under Section 9(5).
I run five cabs for a company's employee transport. Do I need GST?+
Those are your own supplies, so registration is needed once aggregate turnover crosses the threshold, and the client will likely ask for a GSTIN even earlier.
Can a taxi operator claim GST credit on a new car?+
The block on passenger vehicles has an exception for vehicles used to supply passenger transport, so credit may be available. Eligibility depends on how you pay tax, so confirm before claiming.
