GST registration for gyms, studios and fitness centres

Gym and fitness memberships are taxable services, so a gym, yoga studio, CrossFit box or dance academy must register for GST once aggregate turnover crosses Rs. 20 lakh in a year. Annual memberships collected upfront mean many gyms cross the limit within a few months of opening.

What counts towards turnover

  • Monthly, quarterly and annual memberships
  • Personal training fees, including those collected for trainers
  • Group classes, workshops and transformation programmes
  • Supplements, shakers and apparel sold at the counter (a supply of goods)
  • Rent from a juice bar, physiotherapist or other business operating inside the gym

Advances and long memberships

GST on a service is due when payment is received in advance, if that comes before the invoice. An annual membership paid in January is taxable in January in full, not month by month. If a member cancels and you refund part of the fee, issue a credit note within the time the law allows so the tax on the refunded part can be reduced.

Personal trainers who are your employees are not separate suppliers. Freelance trainers paid by you are your suppliers, and their fees are your cost. If the trainer bills members directly, that income is theirs, not yours.

Equipment and credit

Once registered, a gym can claim credit on treadmills, weights, flooring, air conditioning and sound systems bought from registered suppliers, which is significant at set-up. Credit on construction of the building is blocked, but plant and machinery is not. Corporate clients that buy memberships for employees usually cannot claim credit on them, because membership of health and fitness centres is a blocked credit.

Discount offers, referral credits and free months added to a membership reduce the value only if they are known at the time of supply and shown on the invoice. Keep your membership software and payment gateway data reconciled with GSTR-1 every month.

Franchises and branches

A franchisee gym registers on its own PAN and pays GST on royalty and fees to the brand. A gym chain with outlets in two states needs a GSTIN in each. Outlets in the same state can be added as additional places of business. A small studio with only local members can consider the service-provider composition scheme under Section 10(2A) if turnover is up to Rs. 50 lakh, but it loses equipment credit. A professional can help you decide, register and file returns.
