Consent letter for GST registration when the premises belong to a relative

Many small businesses run from a house or shop owned by a parent, spouse or other relative, with no rent. In REG-01 this is the 'Consent' type of possession. You upload a consent letter from the owner along with a document proving their ownership.

What the officer looks for

The officer wants to see that the person giving consent is the legal owner and that they have agreed to the applicant using the premises for business. The relationship itself is less important than the paper trail from owner to applicant.

Documents to upload

  • Consent letter signed by the owner, naming the applicant, the full address and stating that the premises may be used for business and GST registration without objection.
  • Ownership proof in the owner's name: electricity bill, property tax receipt, municipal record or sale deed.
  • If the owner has died and the property is not yet transferred, documents showing the legal heirs and consent from them.
  • A copy of the owner's identity proof if your officer asks for it.

Common mistakes

  • Choosing 'Own' as possession because the property is in the family, when it is legally in someone else's name.
  • Consent letter signed by the applicant on behalf of the parent.
  • Electricity bill in the name of a grandparent who has died, with no explanation.
  • Using a residential address with no indication of which part is used for business.
  • Consent letter undated or without signature on the last page.

Step by step

In Principal Place of Business, select 'Consent' as nature of possession, enter the address as it appears in the ownership document, and upload the consent letter with the ownership proof as one PDF. Write the consent on stamp paper if your state's officers usually expect it. Keep originals handy for physical verification.

If it went wrong

If you chose 'Own' wrongly and got a query, explain the actual position in REG-04 and attach the consent and ownership proof. If the application was rejected, refile with the correct possession type. Once registered, keep the consent letter current if ownership changes in the family.
