DRC-09 is an order under Rule 143 directing a specified officer to deduct your unpaid GST dues from money that office owes you. It is commonly seen by contractors and suppliers to government departments, local authorities and public sector bodies.
Section 79(1)(a) allows the proper officer to deduct, or require a specified officer to deduct, the amount payable from any money owing to the defaulter that is under the control of that officer. Through DRC-09, the GST officer asks the paying office to withhold the amount from your bills and pay it to the government.
Specified officers include officers of the Central or State Government, local authorities, boards and corporations that make payments to you. Contractors often discover DRC-09 only when a bill is paid short.
DRC-09 is a recovery step. It follows an amount that is already recoverable: a confirmed demand not paid within the time allowed, or unpaid self-assessed tax or interest after intimation. It is not issued for an amount that is only proposed in a notice.
Write to the GST officer with copies to the paying office, attaching proof. Once the dues are settled or stayed, ask the GST officer to withdraw the DRC-09 communication in writing; paying offices usually need that before releasing withheld amounts. A professional can handle this correspondence and follow-up with both offices.
