GST DRC-11 explained: notice to the winning bidder in a GST auction

DRC-11 is the notice sent to the successful bidder after a GST recovery auction. It requires the bidder to pay the full bid amount within 15 days from the date of auction. Once paid, possession is handed over and a sale certificate is issued in DRC-12.

For the successful bidder

Read the notice for the amount, the account or mode of payment and the date. Rule 144 sets the period at 15 days from the date of auction. Keep proof of payment and coordinate with the officer for physical delivery of the goods.

Read the auction terms again before paying, including any taxes or charges payable by the buyer and the time allowed to take delivery. Delay in collecting goods can create storage charges.

  • Pay the full bid amount, less any pre-bid deposit adjusted as stated
  • Keep the e-auction and payment records
  • Collect the sale certificate in DRC-12
  • Check that the description and quantity match what you bid for

If the bidder fails to pay

A pre-bid deposit taken from the bidder can be forfeited if the successful bidder fails to pay the full amount. The officer may then proceed with a fresh auction.

For the person whose goods were sold

DRC-11 means the auction has taken place. Ask the officer for the auction result, the sale amount, the expenses deducted and how the proceeds have been applied to your dues. If the proceeds exceed the dues and expenses, request the surplus in writing. If you believe the sale was conducted at a gross undervalue or without due notice, take legal advice promptly.

Same form for transit detentions

Rule 144A uses the same DRC-10, DRC-11 and DRC-12 sequence for goods or conveyances detained or seized under Section 129 where the penalty was not paid within the time allowed. In that context, the 15-day period can be reduced for goods likely to lose value.
