DRC-17 is the notice for auction, including e-auction, of movable or immovable property attached through DRC-16. It is issued under Rule 147 and states the property to be sold and the purpose of the sale.
Under Rule 147, the auction cannot be held earlier than 15 days from the date of the DRC-17 notice. Perishable or hazardous goods, or goods whose upkeep would exceed their value, can be sold earlier. The notice period is the defaulter's last practical window to settle.
If the dues and the expenses of recovery are paid before the sale is completed, the rules provide for cancellation of the auction and release of the property. Get the amount to be paid confirmed in writing and pay against the demand.
Payment made after the auction may not undo the sale. Do not wait until the day before the auction date; banks and portal payments can take time to reflect, and the officer needs time to issue the cancellation.
Read the notice and auction terms: reserve price, pre-bid deposit, inspection dates and payment terms. The successful bidder receives DRC-11 to pay, and a sale certificate in DRC-12 after full payment. Check for disclosed encumbrances and title issues before bidding, as you would for any distress sale.
Where no bids are received, or bidding is non-competitive due to low participation or low bids, the officer can cancel and re-auction. Meanwhile, the attachment continues. Proceeds of a completed sale go towards the dues and expenses; ask for an account and any surplus.
