GST REG-21 explained: getting a cancelled registration restored

GST REG-21 is the application to revoke an order cancelling GST registration that the proper officer passed on his own motion. It must be filed within 90 days of service of the cancellation order, after clearing pending returns where cancellation was for non-filing.

Who can apply

Under Section 30 and Rule 23, a registered person whose registration was cancelled suo moto by the officer can seek revocation. If you cancelled your own registration through REG-16, revocation is not available and a fresh registration is needed.

Time limit

File within 90 days from the date of service of the REG-19 order. Rule 23 allows the Commissioner or an authorised officer to extend this by up to 180 more days where sufficient cause is shown and reasons are recorded. After that, an appeal or other remedy is needed.

Before you file

Where registration was cancelled for not filing returns, you must file all returns due up to the date of cancellation and pay the tax, interest, penalty and late fee. Returns for the period between cancellation and revocation must be filed within 30 days of revocation.

  • File pending GSTR-1 and GSTR-3B, or CMP-08 and GSTR-4 for composition
  • Pay dues from the cash ledger
  • Update bank details under Rule 10A
  • Gather proof that the business is operating at the address

How the officer decides

If satisfied, the officer revokes the cancellation in REG-22 within 30 days of receipt of the application. If not, he issues a notice in REG-23, to which you reply in REG-24 within 7 working days. The officer then decides within 30 days of the reply.

Practical advice

Explain briefly why the default happened and what has been fixed. A professional can file the pending returns, the REG-21 and any REG-24 reply, and attend hearings.

Revocation applies only to the same business carrying on under the same PAN. If the business itself has changed hands, a new registration is the correct route.
