GST REG-19 explained: your GST registration has been cancelled

GST REG-19 is the order cancelling GST registration, issued either on your own application in REG-16 or after a REG-17 show cause notice. Once passed, you cannot make taxable supplies under that GSTIN, and you must clear dues and file the final return.

What the order contains

REG-19 states the date from which cancellation takes effect, the reasons and any amount payable. That amount includes tax on stock, input tax credit to be reversed under Section 29(5), and any interest or penalty. The order may take effect from a back date, which affects invoices and credit for that period.

Immediate consequences

  • You cannot issue tax invoices or collect GST under the cancelled GSTIN
  • Buyers cannot claim credit on invoices issued after the effective date
  • E-way bills cannot be generated
  • Dues shown in the order are recoverable as arrears
  • The final return GSTR-10 is due within three months

Option 1: revocation

If the officer cancelled the registration on his own motion, you can apply for revocation in REG-21 within 90 days of the order. Where cancellation was for non-filing, all pending returns and dues must be cleared first. The period can be extended on sufficient cause, as allowed by Rule 23. Revocation is not available when cancellation was on your own request.

Option 2: appeal

If the order is wrong on facts or law, or revocation is rejected, a first appeal can be filed in APL-01 within 3 months of communication, extendable by one month. Where the order demands tax, a pre-deposit of 10% of the disputed tax applies. Further appeal lies to the GST Appellate Tribunal.

Acting quickly

Many cancellations follow missed returns or a failed site visit and are fixable. A professional can file pending returns, prepare the revocation application and represent the case at hearings.

Questions

REG-19 — FAQs

Can a cancelled GST registration be restored?+
Yes, if it was cancelled by the officer, through a revocation application in REG-21 within 90 days, or through an appeal.
Can I apply for a new GST registration instead of revocation?+
A fresh application may be scrutinised against the earlier cancellation and dues. Revocation is usually the cleaner route if the business is the same.
Is GSTR-10 required if my registration was cancelled by the officer?+
Yes. The final return is required whether cancellation was voluntary or by the officer.
From which date does the cancellation apply?+
From the date stated in the order, which may be earlier than the order date. Check it carefully because it decides which invoices are affected.
